1. The purpose of SCMG is to manage the water area of the Marina du Bouveret. In this capacity, SCMG maintains the port, mooring places, the canal, the turning bridge and any other installation, including hydraulic installations, related to the Marina. It acts at all times in the interest of the shareholder co-owners. 2. It may acquire and sell real estate and carry out all operations and conclude any contract suitable for developing its purpose or related thereto. 3. To the extent that the purpose of the company is to enable each owner of the Marina to have a mooring place, an apartment can only benefit from one or two mooring place servitudes. By 'apartment', a housing unit is meant, regardless of the number of PPE lots constituting it. 4. The above paragraph 3 adopted at the general meeting of May 25, 2019 is not applicable retroactively, so that the situation of apartments already having more than two mooring places does not need to be regularized. The PPE lots thus benefit from an acquired right situation. Consequently, the state of servitudes attached to these lots undergoes no modification, whether or not a sale of the lots occurs. A contrary intention of the seller or a new acquirer of the lots in question to transfer or delete the mooring rights on the concerned apartments is reserved. The rights thus detached will be subject to the statutory restriction of two mooring places per housing unit. Furthermore, if the new acquirer is not interested in acquiring all the mooring places and no other owner of the Marina wishes to acquire the remaining mooring places, they may be taken back by the Cooperative Society, the final decision being the responsibility of the general meeting, competent financially.
